Terms & Conditions

The following Terms & Conditions shall be valid in case of order and will be part of the contract for sale that both parties, Photographer and Collector, shall sign before the order will be considered valid.

Limited Edition Print
The prints are part of a limited edition. An edition is a limited “run” – number of times each image can be printed- of a particular piece of artwork in a particular size. It’s the total number of prints that will ever be sold of that specific size. There will also sometimes be a few photographer’s proofs (never for sale), which are for quality checking purposes and for the photographer to be able to exhibit and/or use in his portfolio.
All prints are signed and numbered by Nico Chiapperini. Editions of 25 prints or less are numbered with Hahnemühle Certificate of Authenticity. The certificate is made of premium deckle edged mould made paper with a Hahnemühle watermark and fluorescent security fibres, with a serialized numbered hologram added. A second, identically numbered hologram is applied to the reverse side of the print. Photographer reserves the right to withdraw any of the prints listed for sale at any time.

Payment
Collector shall pay by credit or debit card using Paypal within 15 days from the sign of the contract. Regarding financial transactions, you should refer to the Terms and Conditions of Paypal.
The prices of the prints as published on this site exclude any postage fees.

Delivery
The Photographer shall arrange the delivery not later than 30 days after the payment has been received. The expenses of delivery (including, but not limited to, insurance and transportation) shall be paid by Collector if not included in the price in the contract.

Customs
Sales tax in The Netherlands is included in the price. Some countries may apply additional taxes or custom fees when prints are picked-up and/or delivered: Photographer is not responsible for such taxes or custom fees. Collector is responsible if the Work is returned, held, confiscated, or destroyed by customs due to Collector’s failure to pay appropriate import taxes/customs charges, or comply with customs laws for country of destination.

Risk of Loss and Insurance
If Photographer will arrange the delivery to the Collector’s location, the risk of loss or damage to the Work and the provision of any insurance to cover such loss or damage shall be the responsibility of the Collector from the time of delivery. In case Collector will arrange the pick up of the Work and the delivery to his location, the risk of loss or damage to the Work and the provision of any insurance to cover such loss or damage shall pass to the Collector at the time of purchase.

Return Policy
Returns claims must be made within 7 days from the date that your print was delivered, writing an email to info@nicochiapperini.com with the subject line “return”, followed by the contract number.
Work must be returned complete and undamaged using the original packing where possible. The expenses of return shall be paid by Collector.
Refunds will be granted and processed through Paypal only in case Work is returned complete and undamaged.

Copyright and Reproduction
The Photographer reserves all reproduction rights, including the right to claim statutory copyright, in the Work. The Work may not be photographed, sketched, painted, or reproduced in any manner whatsoever without the express, written consent of the Photographer. All approved reproductions shall bear the following copyright notice: © by Nico Chiapperini 2016.

Non-destruction
The Collector shall not destroy the Work or permit the Work to be destroyed without first offering to return ownership of the Work to the Photographer or his successors in interest.

Integrity and Attribution
The Collector shall not distort, mutilate, or otherwise alter the Work. In the event such distortion, mutilation, or other alterations occurs, whether by action of the Collector or otherwise, the Photographer shall, in addition to any other rights and remedies, have the right to have his name removed from the Work and no longer have it attributed to him as its creator.

Resale Proceeds
On resale or other transfer of the Work for a price or value in excess of that paid, the Collector agrees to donate to The Dutch Cancer Society KWF 25% of the gross sale price received or, if the Work is transferred other than by sale, to donate 25% percent of the fair market value of the Work as of the date of transfer. In case KWF will not exist any more at that time, Collector will donate money to a different Cancer Society, considering firstly a Cancer Society of the country in which he or she lives. Collector shall include in any contract of sale a provision that the next owner shall agree to such a resale proceeds right and also to bind the following owner to comply with the provision.
